Wills vs. Trusts: What’s the Difference and Why Does It Matter?

When people start thinking about what will happen to their property after they’re gone, one of the first questions that comes up is: What’s the difference between a will and a trust? While both are common tools used in estate planning, they serve different purposes and work in different ways.

Understanding these basic differences can help make sense of what each document typically does and why someone might use one—or both—as part of their overall planning.

What a Will Does
A will is probably the most familiar estate planning document. In general, it lays out how someone wants their property to be handled after they pass away. It can also name guardians for minor children and appoint a personal representative to carry out the wishes outlined in the document.

Wills usually go through probate, which is a court process that helps ensure everything is done according to the law. This process can vary depending on the situation, but in most cases, it’s a public process that involves validating the will and distributing the estate.

What a Trust Does
A trust is a bit different. It’s a legal arrangement where one person (called the grantor) transfers assets to someone else (the trustee) to manage for the benefit of others (the beneficiaries). Trusts can take effect during a person’s lifetime or after they’ve passed, depending on how they’re set up.

One reason people use trusts is because certain types can allow assets to avoid probate, which can make the transfer process a bit smoother and more private. Trusts also offer flexibility—some are used for long-term planning, like managing money for children or loved ones with special needs.

A Few Key Differences

  • Timing: Wills only take effect after death. Some trusts begin during a person’s lifetime.
  • Court Involvement: Wills usually go through probate; trusts often don’t.
  • Privacy: Wills become part of the public record. Trusts generally stay private.
  • Ongoing Management: Trusts can provide for the ongoing care or financial management of assets.

Why People Sometimes Use Both
It’s not uncommon for someone to have both a will and a trust. A will might cover things like guardianship or personal items, while a trust might be used to manage property or financial accounts. How these documents are used together depends on the person’s goals and circumstances.
