Legal Custody vs. Physical Custody: What’s the Difference?

Custody isn’t one-size-fits-all. Learn the difference between legal and physical custody—and how these terms affect parenting after a divorce or separation.

If you’re going through a divorce or separation and have kids, one of the first things you’ll likely hear is: “How will custody work?” It’s a big topic—and understandably, an emotional one. But before diving into parenting schedules and decisions, it helps to understand what custody actually means.

In Minnesota, custody is split into two key categories: legal custody and physical custody. They sound similar, but they cover very different aspects of parenting.

Let’s break it down.

What Is Legal Custody?
Legal custody is about the big-picture decisions in a child’s life. That includes things like:

  • Where they go to school
  • What kind of medical care they receive
  • Whether they’re raised in a particular religion
  • Other major life choices

In many cases, parents share legal custody, meaning they make these decisions together. But it’s also possible for one parent to have sole legal custody, depending on the situation.

What Is Physical Custody?
Physical custody is about the day-to-day part of parenting—where the child lives, who’s making dinner, getting them to school, and tucking them in at night.

There are a couple of ways this can look:

  • Sole physical custody – The child lives primarily with one parent.
  • Joint physical custody – The child splits time between both parents, though it doesn’t always mean a perfect 50/50 split.

What works best often depends on the family’s routines, the child’s needs, and what both parents can reasonably support.

Where Parenting Time Fits In
You might also hear the term parenting time. That refers to the actual schedule—when the child spends time with each parent.

So while custody defines legal rights and responsibilities, parenting time is about when and how often each parent sees the child. A parent can share legal custody but have less parenting time, or vice versa. Every situation is a little different.

How Courts View Custody in Minnesota
When custody decisions go through the court, the main focus is the best interest of the child. That includes factors like:

  • The child’s relationship with each parent
  • Each parent’s ability to care for the child
  • The child’s routine, school, and community connections
  • Communication and cooperation between parents

In many cases, parents come to an agreement on their own or through mediation, and the court reviews and approves that plan.

Custody doesn’t just mean “who gets the kids”—it’s a combination of legal rights and practical parenting. Understanding the difference between legal custody and physical custody can help take some of the mystery out of the process and give you a clearer picture of what’s ahead.

David V. Hurt is a seasoned litigator who has been advocating for individuals, families, and businesses across Minnesota since 2012.
